Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the MudLog weather-triggered stormwater compliance platform and SMS alert service ("Service"), operated by MudLog ("we," "us," or "our") and accessible at getmudlog.com. By signing up for or using MudLog, you agree to be bound by these Terms.

MudLog SMS Alert Program

Program Name: MudLog Rain Alerts

Program Description: MudLog sends automated SMS text messages to notify construction site managers and stormwater compliance personnel when qualifying rain events (meeting your configured threshold) are detected at their registered job sites. Messages include precipitation data, inspection instructions, and report confirmations.

Message Frequency: Message frequency varies based on weather events at your monitored site(s). You may receive multiple messages during active rain periods. Typical frequency ranges from 0 to 10 messages per month per site, depending on local weather patterns.

Message & Data Rates: Message and data rates may apply. Contact your wireless carrier for details about your text messaging plan.

Opt-Out: You can cancel SMS messages at any time. Text STOP to any MudLog message to unsubscribe. After sending STOP, you will receive one final confirmation message and no further messages will be sent.

Supported Carriers: MudLog messages are supported on all major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages.

1. Service Description

MudLog is a weather-triggered compliance automation tool for construction sites subject to Stormwater Pollution Prevention Plan (SWPPP) requirements. The Service monitors precipitation at your registered site locations and sends SMS alerts when qualifying rain events occur, enabling timely documentation of Best Management Practice (BMP) inspections.

2. Account Registration & Opt-In

To use MudLog, you must provide a valid cell phone number, email address, company name, and site location. By checking the SMS consent checkbox on our signup form and submitting your information, you expressly consent to receive automated text messages from MudLog at the phone number provided.

You represent that you are the owner or authorized user of the phone number provided and that you are at least 18 years of age.

3. SMS Messaging Terms

By opting in to MudLog SMS alerts, you agree to the following:

  • You will receive automated SMS text messages related to rain-triggered stormwater inspection requirements at your registered site(s).
  • Message frequency varies based on weather events. You may receive alerts, inspection reminders, report confirmations, and service notifications.
  • Message and data rates may apply depending on your mobile carrier and plan.
  • To opt out of messages, reply STOP to any MudLog message. You will receive a confirmation and no further messages.
  • For help, reply HELP to any MudLog message, or email support@getmudlog.com.
  • Your consent to receive SMS messages is not a condition of purchasing any goods or services, though it is necessary to receive the rain alert functionality of the Service.
  • Your phone number and opt-in information will not be shared with or sold to third parties for promotional or marketing purposes.

4. Subscription & Billing

MudLog is billed at $49 per active site per month. No credit card is required at signup. We will request payment after your first compliance report is generated or after 14 days of monitoring—whichever comes first.

You may cancel your subscription at any time. Upon cancellation, monitoring and alerts for the associated site will cease at the end of the current billing period.

5. Accuracy & Limitations

MudLog uses third-party weather data sources to detect precipitation events. While we strive for accuracy, we do not guarantee that all rain events will be detected or that alerts will be delivered in real time. SMS delivery is subject to your carrier's network availability.

MudLog is not a substitute for professional stormwater engineering, legal compliance advice, or on-site judgment. You are solely responsible for ensuring your site meets all applicable environmental regulations, including EPA and state SWPPP requirements.

6. User Responsibilities

  • Provide accurate site locations and contact information.
  • Respond to alerts and conduct inspections as required by your applicable regulations.
  • Do not use the Service for any unlawful purpose.
  • Keep your account information up to date.

7. Intellectual Property

All content, features, and functionality of the MudLog platform, including the website, logos, designs, and reports, are the property of MudLog and are protected by copyright and trademark laws.

8. Limitation of Liability

To the maximum extent permitted by law, MudLog shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to missed alerts, delayed messages, inaccurate weather data, regulatory fines, or lost data.

MudLog's total liability for any claim related to the Service shall not exceed the amount you paid to MudLog in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless MudLog and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your failure to comply with applicable environmental regulations.

10. Termination

We may suspend or terminate your access to MudLog at any time, with or without cause, upon reasonable notice. You may terminate your account at any time by contacting us at support@getmudlog.com.

11. Modifications to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the revised Terms on this page with an updated effective date. Your continued use of MudLog after changes are posted constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law principles.
